The present barriers of implementing Chinese female labour rights are caused by various reasons, such as stereotyped social concepts, female physiological differences, rational choice of market economy, and the incomplete law system. Therefore, it is necessary to make a combination of the theory of fairness and justice, and human rights in the level of law basis to analyse the women’s labour rights in China’s judicial system, stating that the female labour should be protected by using a dynamic combination of formal equality and essential equality. Based on an analysis of the present limits standards and reality in protecting women’s labour rights in China’s judicial system, this paper aims to improve the legislation framework of protecting women’s labour’s rights by providing a certain degree of essential human concerns in the legal process(legislation, enforcement and judiciary). Relevant responses or measures can be made to protect the rights of female labour and to contribute further legalization and realization of human rights.
