The Autonomous Owner Group

Owner group is a new concept of the housing reform in our country,in fact it is in each community owner to implement personal interests and common interests together management of village affairs organization.National legislation has a different name,France “The ownership of residential stratification method” is called collaborative management group;Germany “residential ownership law” is called common housing ownership relationship between groups, namely residential community of all; Japan “the building differentiation ownership laws” will be divided into three categories: management groups,the combination of legal person and the community management.No matter how its name,it will be an important concept in the new civil law field.Commercial housing marketization trend gradually strengthen in the 1980 s, the city communities,the number of scale expanding, the great changes of people’s living style,evolved from previous single-family house way of living together as a way of life,in addition to the need to deal with the relationship of the ownership of a proprietary parts also need to deal with the common parts mutual relations.The emergence of this new type of legal relation of community management challenges are put forward.This article applies the method of comparative analysis,empirical research, the relevant concepts of community autonomy from owner, manage account owner groups need to abide by the principle of the role of community self-governance and owner,political science,sociology,the theories analysis owner legitimacy of community self-governance,and comparison of foreign legislation owner content of community self-governance in China,including the content of the management,operation of the owner convention,owner groups such as content,on the basis of the above theoretical analysis,a series of problems faced by the current owners autonomous,has its own internal problems,such as owners autonomous institutions system defects,also has conflict with the external organizations,such as the national public power intervention in owner issues of community self-governance.By revealing the group owner autonomy of different problems,some suggestions and measures,in order to enrich the owner autonomous theory, in the practice of solving some problems.
