Legal Principles’ Review And Path Reconstruction For The Mainland Of Owner Autonomy

The process of urbanization in China, the number of owners is on the increase, and the owners have owner power which is a social power. The social power and the state power complement and restrict each other, and the autonomy is a concrete manifestation of social power. The autonomy of owners is important to protect the owners’ real rights,maintain public order and improve democracy and rule of law in China. Undeniably,current owners’ autonomy has a lot to be improved, such as the low level of owners’ participation, the difficult operation of owners’ autonomous organization, the absence or overstepping of government in the autonomy of owners, low quality of service provided by property management companies, and weak effectiveness of rules for owners’ autonomy, so we need to improve and put forward a set of ideal pattern for owners’ autonomy. From a fair perspective, we need to affirm the guiding role of government,believe the regulation function of market and enhance the autonomous perception and ability of owners.
