Because of the changes in the physiological and psychological aspects attributed to age, the older consumers spend a lot in health area which including healthy production. However, the number of consumer dispute grows up with the boom of health products consumption, prosecuting older consumers and their families. And older consumers often have troubles in protecting their rights under specific sales patterns. In the relationship between older consumers and health product vendors, according to the special points in consumers, products, sales pattern and social effects, we need to take special research on this special relationship.First of all, we should make it clear that the contract between the older consumers and the vendors are legal. As a person with full capacity for civil conduct, an older customer has no defect in conducting his rights, so he has to perform his legally valid contract with the health product vendor. All the research of this essay are based on this.However, the consume relationship of this essay has some special points as followed:Firstly, the consumers are special. Due to their function degradation in physiological and psychological aspects, older consumers are in the weaker position than common consumers and easier to be misled, therefore they should be tilt protected by law. Secondly, the products are special. Component, features, and effects of health products are different from common type of food supplies, correspondingly, the requirements of consumer’s knowledge base and ability of understanding and acceptance are higher. Thirdly, the sales patterns are special. Health products vendors often use provocative, seductive, misleading or deceptive promotional sales patterns, so that older consumers are affected by its unreasonable effect while signing the contract and their purchase options are directly affected. Fourthly, large amounts of older consumers in the purchase of health products suffer losses, and the situation tends to be common phenomenon in society, so it may be unfair to the whole evolution of the elderly population if we let this situation alone. These special points decide that we cannot rely solely on existing laws and regulations when dealing with the relationship between the older consumer and health products vendors. Instead, we shall aim at the particularity of this relationship, giving the interests of older consumers special protection.Giving special protection to older consumers beyond the freedom of contract to protect its interests has legal, ethical and practical basis, and is justice.The tilt protection to the interests of older consumers should be performed by a number of subjects and from multiple angles, protecting the health and economic interests of older consumers.All in all, to protect the interests of older consumers buying health products in Specific sales patterns, we can conduct through the measures of law enforcement, judicial, social, family and any other perspective. Following the principle as "respect the will, protect in moderate ", we can protect the elderly’s rights with the scope of the law and create an honest market environment and an elderly-respected social environment.
