After the the Sino-Japanese War,the powers to obtain the right to set up factories in China, and the forces of expansion, foreign investment flooded into the pitch to set up factories in China, mining, delusions steal entire inland areas of mineral resources. Faced with China’s massive spill patent rights, and the pressure of public opinion, the end of the Qing Dynasty central government have introduced a number of mining regulations and the Articles of Association, seeking to protect the rights of Chinese businessmen mining, limiting foreign investment approach. As the law is often accompanied by changes in the superstructure of economic policy and changes in imperialism’s aggressive growth, lawmakers are also reflected in the prevailing social background.In this paper, examples of Jiaozuo Coal Mine started to sort out the mining regulations and policies during the Qin Dynasty to the 1927 enactment of the Kuomintang government and other various periods, with a focus on mining law reform to analyze the late Qing Dynasty and early Republic of China to carry out, and the introduction of this period of mining a comparative analysis of the law. Throughout the late Qing Dynasty Mines legislative reform, basically focusing on how to prevent the invasion of foreign capital, the end of the Qing Dynasty central government does not care about the management system of mining, only interested in a stable and mining tax ruling order, blindly copying Western Mining law, not seriously learn the advanced management concepts and mining technology, resulting in the local mining tradition and foreign mining competition has been at a disadvantage, especially in a community-wide tradition mine owners are great views. Rulers in various periods during the late Qing Dynasty blindly copying Western mining law, can not meet the actual needs of China, the lack of localization, mining law reform ultimately did not play its due role.
