The Analysis On The Roles Of The Village Committee Plays During The Rights Transformation Of Lands In Rural Area

Nowadays the lands using principle in rural area have to face some changes for the shortage of the household contract responsibility system and the expansion of urbanization--on one hand, the accelerated need of urbanization demands more rural agricultural lands to become constructional use via levy, on the other hand, for the purpose of chasing interest, more and more villagers release their right to contract for land management, and send them into market. Embarrassed by the comparatively weakness of singular villager(especially on information possession, Risks prediction), lacking the abilities to resist the risks of land property comes into the market freely. AS an organization generated and accompanied with the changes of the system of rural lands, and based on the widest grass-root, the villager committee aims to safeguard the interest of the peasant, and a critical point to protect the order of the land exchange market. The villager committee acts as a role of manager of the village affairs empowered by the Constitutional Law and the organization Law of the village committee. The village committee takes part in the land levy and exchange affairs. Furthermore, the village committee plays various roles such as delegate of the collective, watchdog of land use, assistant of the government, service provider, even legal entity,which could be mutual contradicted, for the blurred conception of “the collective”. In some cases, the committee(member)betrayed the original duty, be an accessory to persecute villagers who don’t gave in on unreasonable land levy, or abuse their power in rural land exchange, which deeply hurt the interest of the villagers. To look into the reason, lacking of independence is the mainly excuse, the village committee plays several roles and fails to exercise its original duty, and lacking of supervision, the village committee incline to abuse its power. In order to rebuild the proper character, the Legislature should give an accurate definition on the roles of the village committee, keep it independent, enhance the strength of democratic supervision of villagers, and more deeply reformation is needed on land levy, empower the decision right to the market, so that the rooted obstacle disturbing the village committee function could be reduced.
