In order to maintain the basic living standards of the poor and low-income families and protect the rights of the survival of at least, one after another in cities and towns and rural areas established a system of safeguard of townsman lowest life and the system of subsistence allowances for rural residents in the late 1990 s in China.it was referred to as "urban low-income and rural residents and also was called the system of subsistence allowances. On the one hand, it make government solve the bottom of the social vulnerable groups and people’s basic life suffered sudden disasters instant poverty and guarantee the stability of the social sustainable development to a certain extent. On the other hand, some lawless person with fictitious information and means of concealing the truth diddle low. It has Resulted in the loss of welfare of scarce resources, got social low violation of the equal rights and a decline in government credibility and also accused the public opinion. But due to the lack of social security legal system and the means of punishment against soft of our country.it make the behavior of diddle social low intensified. It was not only a waste of public resources, causing more citizens to question of social justice and the government credibility, and also affected the social harmony and stability as well as the realization of the "China dream".Therefore, this article attempts through the analysis of the status quo and the problems in the operation, through academic theoretical controversy and in reference to the relevant country or region outside of advanced legislative experience and judicial practice on the basis of ideas and obtain subsidies conducts into crime in criminal law as a better choice.
