The Research Of The Protection Of Dispatched Workers’ Labor Rights

Today, with the rapid development of economy, labor dispatching system play an important role in resolve the employment problem and the short-term employment problem of enterprises as a new way of labor employment and develop rapidly. According to a complete "domestic labor dispatching investigation report" of the National Federation of Trade Unions, by the end of 2010, the number of the workers dispatched of our country has reached 60 million, accounted for about 20% of the total number of our workers. In this background, the protection of the rights of dispatched laborers in labor dispatching market is more important. The reality is that with the development and prosperity of the labor dispatching market, it also appeared a lot of damage to the labor rights. The damage is serious to the social fairness and justice. Combining with the development background of labor dispatching system and the research in and abroad, this paper analyses several problems about the damaging of labor rights, such as "unequal pay for equal work", the responsibility of employer unsure and "reverse dispatching" problems. Then it puts forward the corresponding countermeasures and suggestions, including perfecting the relevant laws and regulations, clear the responsibility of dispatch institution and employing unit and limit the scope of labor dispatch, in order to protect the labor rights of the dispatched workers in China and promote the continuous development of our country’s labor dispatching system more perfectly.
