Research On The Legal Regulation Of Enforcement-compliance False Confession

Enforcement-compliance false confession belongs to the category of judicial psychology; however, this paper pays more attention to the close relationship between it and unjust, false and erroneous cases. The investigation means have been highly technical now under the rapid development of science and technology, but fails to effectively control the frequent unjust, false and erroneous cases both at home and abroad, and people are still trying to find the occurrence and control mechanism, for example, the western countries have been devoted to the study very early. However, the domestic research in this field has just started; at the same time, with the judicial reform, the investigation measures changing gradually from physical enforcement to psychological enforcement has led to a lot of unjust, false and erroneous cases, attracting the public’s attention. The disconnection between theory and practice, as well as of the arrogant human rights call in international environment, requires our country to be dedicated to the theoretical research on false confessions, in order to keep the pace of judicial practice, maximize the concept of "governing the country according to law". To this end, the author read a lot of domestic and foreign works, and referred to many criminal interrogation cases and the famous psychological tests; on this basis, this paper will try to complete the theoretical concept of countermeasures that can effectively control the enforcement-compliance false confessions.This paper is mainly divided into five parts. The first part is the introduction. The second part is the basic introduction of enforcement-compliance false confessions. The third part mainly analyzes the formation process and cause of enforcement-compliance false confessions. The fourth part takes the Qoysiletu Case as an example to research the formation process and cause of enforcement-compliance false confessions. The last part mainly sets up three lines of defense from the application of science and technology method, the perfection of investigation system and testimony corroborating rule, so as to eliminate the unjust, false and erroneous cases as many as possible.
