Superficial Analysis On Reasons And Solutions For Criminal Wrongs From The Perspective Of Consciousness And Concept

In recent years,with the advancement of the rule of law construction in China,a series of criminal justice in correct gradually entered our field of vision,these being corrected on the one hand makes the winging innocent person wash off the grievances and shame,highlights the gradual progress and improve the outcome of criminal justice in our country,on the other hand,combine the disclosure of the wrongs and torture in the judicial human rights safeguard mechanism of China:why do criminal wrongs occur repeatedly?How can these wrongs utmost groundly to avoid?…… These problems in recent years draw the attention of the vast number of legal professionals and even the society.The analysis of the wrongs judgment is often been reported.By means of 11 criminal wrongs in the White Paper of the news office of the state council of our country on September 12,2016,"the judicial protection of human rights in the field of new progress in China",and combined with the 10 criminal wrongs be referred to in Professor Jiahong He's works-"Ten criminal wrongs,which justice of China effected",it's also the ten big criminal wrongs,about which people in the academic circles talk,for example,Peiwu Du case,Jiuming Li case,wangang Sun case,Xianglin She case,Zuohai Zhao case,Hui Zhang and Gaoping Zhang case,Huailiang Li case,etc..It's not hard to find,these wrongs have similarities in many aspects,it seems that they been copied have.Needless to say,there are many reasons for the happening of the wrongs,we often hear the voice of critical mechanism defect of the judicial system in our country.However,in the context of rule of law,and human rights safeguard mechanism perfecting legal system in China,Criminal wrongs occur time and again.It's true that the mechanism of the legal system in our country certainly its deficiencies and defects have,but if we think it over,disorders of Consciousness concept and contradictions,including legislative,judicial,law enforcement,and the concept of the broad masses of the people and problems of consciousness,this is where the problem lies.This article is based on the current research in China,combining with 11 criminal wrongs in the White Paper of the news office of the state council of our country on September 12,2016.In the following text analyze we reasons of these criminal wrongs from the aspects of Consciousness and concept,and in the end try to put forward some Suggestions.
