Research On Legal Protection Of Livestock Genetic Resources

Livestock genetic resource is an important part of biodiversity, plays a basic role to the survival and development of humanity, the value of genetic resource is increasingly higher. However, livestock genetic resource protection is late in China; it has not been enough to cause the attention in academic circles. About protection of livestock genetic resource mostly from the professional point in zoology, and there’s no system to provide protection from the law. Therefore, livestock resource protection is very important and significant. The Sunid sheep has a long history with excellent genetic resource, it was identified as Inner Mongolian Xilingol’s well-bred serving domestic animal in 1986, were listed in the national list of livestock or poultry genetic resource protection in 2010. As a cold, drought resistant and environment adaptiveness with strong survivability animal, mutton for delicious and high nutritional value, the Sunid sheep, enjoy a higher popularity with consumer’s preferences. Along with the competition of market economy, deterioration of ecological environment and the lack of understanding of the concept, the Sunid sheep genetic resource resources are faced with plight of damage and loss. Although our country has realized the importance of livestock genetic resource protection, and also established the act of the animal husbandry and relevant rules and regulations, provisions of the genetic resources protection system and the management behavior, but the existing legal system has been unable to meet the needs of effective protection. Therefore, the author, where sheep varieties as the research object, trying to build Sunid sheep genetic resources legal protection system, so as to promote the improvement of the system of legal protection of livestock genetic resource.Content of this paper consists of five parts:the first part of the article is to introduce the concept and characteristics of livestock genetic resource basic overview, on paper at the bottom of the theory of information. The second part of the article is to introduce Sunid sheep namely:Sunid sheep physical features of the natural features and special sheep origin characteristics, for the problem to provide comprehensive research in the paper, the actual information base, and also highlight the characteristics of Sunid sheep. Again from Sunid sheep characteristics of endangered, preciousness and rarity and its market value two aspects to analyze the model, the necessity of sheep breeds resources protection. Article third part simply introduces the current in the international and domestic laws and regulations related to the protection of genetic resources of the legislative status quo. The fourth part, according to the first three part of the article, on the basis of the analysis concludes that Sunid sheep main problems of legal protection of genetic resources, mainly is the legislation, management system and the protection measures three aspects to analyze. The fifth part of this article is the improvement for the legal protection countermeasure of the livestock genetic resource, according to the summary of existing problems and reference foreign advanced practice, to present advise for legal protection of livestock genetic resource, namely national and local levels of the perfection of legislation, management system, the improvement of the protection of origin, and links to intellectual property law protection.
