The Research Into Forestry Right Transference

As is showed in the current forestry right transference, China has not established a sound market trading mechanism about forestry right. Our government has been attaching more importance to the primary circulation of forestry right, and owners of woodland can transfer their forestry right to other social subjects including citizens, legal persons or other organizations by contracting, auctioning or renting according to the law. However, as to the recirculation of forestry right, our government has not paid enough attention, so the secondary market trading mechanism is far from perfect. Considered as one of the important aspects of forestry right, the limited right to transfer woodland affects the profit of investors, which curbs investment enthusiasm. This phenomenon not just affects the scale woodland use, causing bad influences on forestry industrialization, and what’s worse, it can affect the sustainable development of forestry in the long run. As an essential productive factor, the natural features of forestry determines the fact that only through scale use can we get the best profit from forestry. But since the forestry right reform, our country’s woodland, especially rural collective woodland, has been dispersed to peasants broadly by primary circulation, which prevents the industrial management of woodland to some degree. If we aim to achieve the reasonable allocation of forestry resources by collecting masses of odd woodland, we must perform the recirculation of forestry right. However, because of laws’ hysteretic nature, the existing laws limit, even lack related regulations about the forestry right transference, making the legal protection of forestry right transference poor and the circulation channel not smooth. As a result, the laws can’t meet the need of forestry development.In this paper, it arranges and concludes the current facts of forestry right transference in our country, finds out relative problems, analyze possible causes and put forward corresponding measures in laws and regulations.
