With the rapid development of China’s real estate industry, more and more lacks of real estate related legal system arise In the process of trading highlights.the problems which caused by the unclear nature of the real estate registration are difficult to solve, such as having no unified registration authority,no clear registration examination mode, not sure of the nature of error registration responsibility and so on. And the key to solve this problem is to definite the nature of the real estate registration. In this paper, the author is committed to definite private law nature of real estate registration, and puts forward the theoretical and practical basis and tries to solve the above mentioned problems.There are two writing methods in this paper:Literature research method and case study method. It shows the influence of the nature of the real estate registration to the legal effect and responsibility of registration, and then make it as the breakthrough point to discuss the nature of the our country real estate registration to provide research conclusion for the nature of the real estate registration review and error registration responsibility nature. At last these conclusions will play a guiding role to establish and perfect our country real estate registration system.Firstly, this paper summarizes the historically related regulations on the management of real estate or real estate and sets out existed theory about the real estate registration properties and the important problems studied in this paper. Secondly, the second and third part introduce factors which can cause the dispute of the nature of real estate registration, such as the administrative tendency of registration of representation, the legal effect and responsibility of registration, relief way of error registration and so on, then it concludes the highlight the theoretical problem. The fourth part compares real estate registration with industrial and commercial registration and determines the private nature of the real estate registration and sets out the theoretical and practical basis. The last of this paper introduce the guiding significance of the private nature of the real estate to the real property registration system and even the real right system.
