On The Legal Status Of Tang Dynasty’s Households

The household is the product of china’s social that development to a certain extent. It i s the basic subject unit of management, which originated from the household registration sy stem. The ruling class using it to get effective control and manage the masses of the peopl e, to levy taxes and corvee formulation. The household registration system is the origin of ho useholds which as the main unit. We should analyzed the relationship between the concept of "household" and "home" if we want find the reason why people chose “household”as the main body. Ancient is different from modern, while individual as the subject of un its in modern. People in the old time are not individuals but generally forms roughly t o such a small unit like "home", for the influence of various ideological, political, cultura l and other factors, as a legal subject to face the government, to carry social responsibilit y and obligation. But the concept of "home" is fuzzy, does not favor the ruling class throug h which to achieve effective control of the society, therefore, "the household" has developme nt gradually to be the subject of law, which is more clear and specific, not entirely to the fa mily blood as the contact unit, to manage society, control standard of the people.Therefore, the concept of the household is developing intertwined with the concept o f family. The Chinese dynasties are less likely to distinguish "household" and "family", gen erally follow the ancient literature records, equate the household and the family. Now some s cholars put forward some different views, think they can not simply be equated, because the y are different concepts, should distinguish. For the fact that my ability is limited, for more pr ofound research, proposed on the basis of previous studies combined with the Tang Dynasty li terature and archaeological data to explore the legal status of "household".Households play an important role of law in the traditional society, contact with all aspe cts of people’s daily life, it is the cornerstone of the successive government which use i t to control the population. Simply explore the subject status of "household" should not be easy, I would study it from some associated close system of the Tang Dynasty such as ho usehold registration system, tax system. But in this process, we need to be carefully choose th e breakthrough point, such as the tax system which is include richly, we can not lump toge ther, speak generally, just especially close "Hudiao" and "household tax money" that househ olds as a collection object as the entrance, there is no need to mix "mediocre" etc.This thesis is divided into three chapters. The first chapter distinguishes the house hold from family theoretically, find the history and the structure in the Tang Dynasty. The twice chapter from the household registration system, the system of taxes and mi gration escape problem analysis the subject role that households play in these systems.The third chapter tries to discuss and summary the development direction of househo lds in Japan and realistic significance in our country.
