The Study About The Marriage Legal System Of Tang Dynasty

Taking Patriarchy and the authority of husband as the core of Tang Dynasty marriage law system, which is the important content of national system, the important symbol of social rank relations, the important aspect of society relates which also the Tang Dynasty law devotes to protect. This paper, taking the Law of Tang Dynasty as the main research object, interpretates the Tang Dynasty marriage law system in detail from the establishment, termination and effect. Meanwhile, it also gives the preliminary comments on the historical status of Tang Dynasty marriage law system, the legislation characteristic, the historical flaw and historical experience for the marriage legislation of our country at present.The paper consists of five parts. The introduction reviewed the reason of selecting this subject, the present researches and mentality of the thesis. The second part elaborates basic principles and characteristic of Tang Dynasty marriage law system. The third part mainly discusses important document of Tang Dynasty marriage law system and its legal effect. The fourth part elaborates the relieving way of Tang Dynasty marriage law system from nature and artificial, and points out its legal effect. The last part is the summary of the paper and author's viewpoints.
