On The Improvement Of Migrant Workers’ Work Injury Insurance System From The Perspective Of Government Duties

Along with the development of market economy and the reform of economical system, the urbanization is accelerating, the market participants have presents such characteristics as diversified production and flexible labor. The rural people have being largely migrated to the cities and towns, and the non-agricultural industries have being gathered to cities and towns gradually, large-scale agricultural labor force turned into non-agricultural one, thus the migrant workers increasingly become a large group. While their life’s focus shifts to the city, based on their cultural degree, labor skills and other conditions, most of them engage in difficult and dangerous physical labor, facing greater accident and occupational injury threats than other people. However, the current industrial injury insurance system has many deficiencies and need to improve. Oriented from the problems, the author analyzes the duty failure of the migrant workers’ industrial injury insurance system and puts forward some suggestions and measures for strengthening the government responsibility and perfect the work injury insurance system for migrant workers, in the hope of providing a useful reference for groups of migrant workers rights protection.The first two parts introduce the research background, significance, review and the related basic concepts and theory of the industrial injury insurance. The third part, from the angle of the developing course of industrial injury insurance in our country, sets forth the current implementation of migrant workers’ industrial injury insurance, and introduces the development of foreign workers’ industrial injury insurance system in order to gain enlightenment and learn the advanced practice. The fourth part sum up the main problems of migrant workers’ industrial injury insurance in our country, including the low rate of industrial injury insurance attendance, the low labor contract signing rate, the complexity of industrial injury dispute settlement mechanism, the difficult investigation for rights protection, and the unsound industrial injury prevention and rehabilitation mechanism, etc. The fifth part expounds on the duty absence of the government in the implementation of the migrant workers’ industrial injury insurance, including four aspects, namely system, law enforcement and supervision, the building of the labor relations and the existing public services. The sixth part, taking the industrial injury insurance system of developed countries and regions for reference, puts forward the suggestions for our government to enhance the migrant workers’ industrial injury insurance system, namely boosting the scientific nature of the migrant workers’ industrial injury insurance policy, improving the executive force of migrant workers’ industrial injury insurance, promoting the prevention and rehabilitation mechanisms of the migrant workers’ industrial injury, and perfecting the supporting safeguard measures for migrant workers’ industrial injury insurance, thus eventually establish a harmonious operating mechanism of industrial injury insurance which integrating “prevention, compensation and rehabilitation” together.
