Education Legislation in a country is very important. It reflects the development of a country’s education, economy and society. In the Constitution of the Socialist Republic of Vietnam, Article 35,It is confirmed the educational capability and goal is: "The development of education always comes high on the list of priorities" Studying and analyzing problems of education legislation will bring great help for education reform, and It will make a significant contribution to social development.Education Legislation is an important concept. In this paper, it is defined that education is the educational legal system, the needs of individual units, national organizations, political-social organizations, mass organizations, economy organizations, the various units of the armed forces and the various other units that needs strict, continuous execution and there is no exceptions.It is 1986 that is an important year. In December 1986, at the Sixth Conference of the Communist Party of Vietnam, the country opened a comprehensive reform, so in this paper, the Education Legislation in Vietnam from 1975 to present is divided into two stages. The first stage is from 1975 to 1986. It is about the Vietnamese education from national unity to before reforming stage. In this period, the main activity and achievement is the Education Management Units have been standardized the same legal documents on education, determining the 12-year general education system. Then, the second stage is from 1986 to present. At this stage, the Vietnamese Educational legislation has a lot of achievements, but obviously, there are still several serious problems, too. In these two stages of studying, this paper has analyzed their socio-economic background, main activities and main features. Meanwhile, this paper also analyzes the achievements of the Vietnamese education law course such as:Vietnam Education Act are more and more completed and unified; According to the objective requirements of national law to strengthen the promising management; national administrative reform requirements and a socialist country rights law building; satisfy the basic requirements for innovation and improve education in Vietnam, and major problems such as:the legislations at lower level are severely lagging behind; regional legislations fail to fully reflect local characteristics; legislations for education are regrettably incomplete; the laws and regulations for education are full of cliches without being practical and applicableThis paper is aimed at summarizing those achievements and problems, then studying and analyzing the development prospects of Vietnam’s education legislation. At last, the paper would like to make some recommendations to reform and strengthen the legal education in Vietnam.
