Continuing education is a kind of re-education activity to supplement knowledge and improve the ability of all members of society,especially adults,on the basis of certain academic education,and it is an important part of lifelong learning system.Since the 18 th National Congress of the Communist Party of China(CPC),the state has attached great importance to the development of continuing education,and put forward that it is necessary to actively develop continuing education and improve the lifelong education system.This is a necessary measure to vigorously improve the quality of the people and establish a learning society.It is also an inevitable choice for the in-depth implementation of the strategy of rejuvenating the country through science and education,strengthening the country with talents and driving development through innovation.The positive development of continuing education is of great significance to the improvement of the quality of workers,and it is also of great significance for our country to build a well-off society in an all-round way and fully develop it.At present,some achievements have been made in the development of continuing education in China,but there are still some problems.Promoting the legalization of continuing education and optimizing the legislation of continuing education are the important basis for running continuing education well.The local legislation of continuing education is an important part of the national legislation system of continuing education,and it is an inevitable choice to perfect the legal system of continuing education and promote the further development of continuing education.From the level of the local legislation text which has been formulated and promulgated at present,this paper probes into the norms and shortcomings of the continuing education in various places,and analyzes the reasons,so as to perfect the continuing education.Local legislation is of great value and significance to promote the quality of continuing education.Based on the analysis of local laws and regulations,local government regulations and normative documents of continuing education,this paper tries to place the text inthe context of historical development,explains the rich connotation and internal logic contained in the development and change of continuing education regulations,and explores the path of improvement and perfection based on the problems existing in the text.First of all,using the econometric analysis and content analysis of the policy text to study the local regulations on continuing education,local government regulations and local normative documents of 23 provinces,5 autonomous regions and 4 municipalities directly under the Central Government in China from two dimensions: formal characteristics and content characteristics.Secondly,the characteristics of the local legislation of continuing education are summarized and explained in combination with the text.Thirdly,based on the text and the actual situation,the paper reflects on the existing problems of local legislation and makes a reason analysis.Finally,it draws on the relevant experience of foreign local legislation,and puts forward some suggestions to optimize the local legislation of continuing education according to China's national conditions.The study holds that the local legislation of continuing education can be divided into four stages: initial exploration,rapid development,stable development and reform and perfection.the content of local legislation of continuing education in China has something in common in the structure system and the main content,but there are also differences in the content of legislation.The local legislation of continuing education is mainly divided into the local legislation of academic continuing education and the local legislation of non-academic continuing education.The content of local legislation of academic continuing education mainly includes enrollment examination,education and teaching management,charge management and academic status management,while the content of local legislation of non-academic continuing education mainly covers the regulations of continuing education of professionals and the regulations and normative documents of various industries.The former involves the scope of the object of continuing education,the mode of continuing education and the management of continuing education.System,the duty of employing unit,the right and obligation of professional and technical personnel to participate in continuing education,the funds of continuing education,the legal relief of professionals,etc.,the latter mainly standardizes and manages the continuing education and study of professional professionals from the aspects of credit registration,course offering,certificate management,examination registration,base construction and so on.The policy style of local legislation is mainly manifested in notices,methods,regulations and regulations.Continuing education local legislation mainly presents the completeness of legislative content,the regional characteristics of legislation,the diversity of legislative forms and the timeliness and continuity of legislative time.Through combing the policy text,both academic and non-academic continuing education stipulate many links and fields of continuing education,covering the main areas and key issues of continuing education.There are three kinds of local laws and regulations,local government regulations and local normative documents,among which the legal effect of local laws and regulations is the highest.In the process of legal construction of local continuing education,all localities also constantly revise and supplement according to the relevant national laws and regional specific actual opposition French texts,reflecting the timeliness and continuity of legislative time.At present,the problems existing in the local legislation of continuing education in our country are mainly manifested in the lack of standardization of local legislation,which is mainly due to the low legal effect of local laws and regulations,the lack of continuing education law at the national level,the limitations of the object of continuing education,the prominent repetition of legislation and the insufficient construction of teaching resources,and so on.In view of the achievements and existing problems of local legislation of continuing education,combined with the enlightenment of local legislation of continuing education at home and abroad,this study puts forward the following suggestions: speeding up the legislative process of continuing education at the national level and improving the status of continuing education in law;expanding the scope of continuing education so that more people can have the right to receive continuing education and enjoy the opportunity to receive continuing education;Continue to highlight the characteristics of local legislation,according to the characteristic needs of economic development in the region to arrange the school hours and curriculum of industry personnel;improve the contents of laws,regulations and normative documents,Improve the contents of regulations,rules and regulations and normative documents,clarify the language of the text,and enhance the standardization and maneuverability of local legislation.
