A Study On Electric Power Enterprise Administrative Law Enforcement

The electric power enterprise administrative law enforcement as the important means to protect the electricity and maintain the safety of power facilities. Its practical significance is to combat the illegal behavior of involving electricity, safeguard national interests and social stability, to ensure the safety of power supply and utilization. With the deepening reform of electric power system, the functions of the electric power enterprise administrative law enforcement is changed, however its enforcement is not only not perfect, but many problems.This paper mainly consists of the following four parts:The first part is overview of the electric power enterprise administrative law enforcement, it defines the meaning of administrative law enforcement of electric power enterprise, and expounds the importance of the electric power enterprise administrative law enforcement in our country and analyzes the change of administrative functions among the electric power system reform.The second part analyzes theory basis and nature of the electric power enterprise administrative law enforcement.In this paper, the controversial point lies in the nature of the electric power enterprise’s right to stop,by comparing the civil rights and characteristics of administrative power to demonstrate the author’s point of view:stop right is an administrative power, the nature of administrative compulsory measures.Third part puts forward the problems existing in the electric power enterprise administrative law enforcement in our country:the legislation lag of electric laws, regulations, rules,the operation ability of laws and regulations is not strong, laws and administrative regulations is inconsistent; in the process of administrative law enforcement ignores the legal procedures, and law enforcement work lacks of supervision; low quality of law enforcement team, unclear division of law enforcement functions,etc. These problems seriously restrict the electric power enterprises play a powerful role in the power of administrative law enforcement activities.The fourth part in view of the electric power enterprise problems of administrative law enforcement, puts forward some suggestions to perfect:improve the relevant laws, regulations and rules of the electric power, strengthening the legislation of power management; strengthen the supervision and strict law enforcement; strengthen the law enforcement team construction,clarify the responsibilities of administrative law enforcement departments of electric power,etc.
