Study On The Conflict Of Interest Prevention System Of Our Public Officials Of Government Procurement In China

Government procurement shall enjoy the reputation of "sunshine project", it has great significance in regulating the market economy and saving the financial fund, in recent years, with the development of our country’s economy and the improvement of society for public service, the scope and quantity of government procurement is becoming more and more big, the influence of it is become further highlight at the same time. But, a series of conflicts phenomenon also occurs, part of public servants not in accordance with public interest orientation, abuse of pubic power to pursuit self-interest, not only cause the loss of public interest and financial fund, but also disturb the social order. Conflict of interest is the root of corruption, it has become an important topic in Chinese academic circle that how to prevent conflicts of interest and reduce the occurrence of corruption.This article is in the view of the conflict of interest problems which in the field of government procurement, arrange the related domestic literature in the first place, summarize and analyze the conception of conflicts of interest on the basis of predecessors’ research, in order to further clear the definition of conflict of interest especially in government procurement field. Secondly, this paper uses the rent-seeking theory, principal-agent theory and public choice theory, according to the government procurement process, respectively analyzed the conflicts of phenomenon in the key link includes purchase demand determine link, procurement mode selection link, purchasing information release link, extraction of evaluation experts link, evaluation link, and performance acceptance link, and further analyze the cause of the conflict of interest, point out that the discretion, incentive incompatibility, information asymmetry, and the weak supervision is the important cause of interest conflict.Although it has a long history that our country anti-corruption research, but the study of preventing conflict of interest in government procurement filed is still on the exploration stage which emphasis on the pilot cities and unit, has not formed systematic prevention strategies yet. Especially in the aspect of legal system, the professional law about conflicts of interest is still lacking. This paper combed the legal system that preventing conflict of interest in government procurement filed of our country and compared to other countries to find out the problems existing in the system in China. Design the path of preventing conflict of interest to reduce the phenomenon of conflict of interest in the field of government procurement.
