Firstly,this thesis studies the meaning,characteristics of the maternity insurance and the related theory.Matemity insurance is a social insurance system that female employee can get the necessary supplies from the society and country,when they are in pregnant,childbearing and the temporary loss of labor.Its role is to provide health care, medical services and paid vacation. At present,most countries in the world have formulated the corresponding insurance measures of fertility. Sports insurance has the following characteristics:(1)Insurance object is specific,it is mainly for female workers.(2)Maternity insurance benefits is special. (3)Maternity insurance is the risk posed by the reproductive behavior of the normal.(4)Maternity insurance and family planning policy and population policy is closely related to.(5)Pay maternity insurance have one-sided sex.(6)Maternity insurance has dual purpose.It is not only to restore the female laborers,but to guarantee our country to expand production of labor required.The basic theory including the maternity insurance: human rights and humanitarian include,safety,fairness and efficiency,justice.Maternity insurance reflects the recognition of women reproductive social value and respect, could Improve the quality of the population in the right and ensure women equal right to employment. It is still beneficial to the family and social stability and realize the women value.The maternity insurance system problems of China,including the following aspects:the low level of legislation,the narrow coverage,the low level of social pooling, paying not standardized,fund balance rate and the lack of supervision.The thesis suggests that we should reform its current legal system.Firstly, sticking to the following three principles:the basic principles of the country,the basic principle of security and the principle of the combination of unity and suit one’s measures to local conditions.Secondly, the main measures as follows:(1)formulating a unified law,as soon as possible to develop a unified "maternity insurance" column.(2)Expanding the coverage,If can.including male workers.(3)Further standardizing birth insurance business management. (4)To further strengthen the management of birth insurance fund supervision and audit work.Through legislation to establish a balance of maternity insurance rate.(5)Intensify supervision and management, the establishment of punitive measures.
