| Our country has entered a new stage that industry nurture agriculture and cities support rural areas. "No.1 document" of central government in 2015 said encouraging innovation in agricultural science and technology was a key support to develop modern agriculture,2 and the transformation of agricultural science and technology achievements(TASTA) is the inevitable requirement of agricultural scientific and technological innovation, it’s also an import support to enhance the competitiveness of agricultural products. But now, the rate of TASTA is not enough which far to meet the demand of modern agricultural development, and the main imitation is a shortage of funds. Therefore, combining with multidisciplinary knowledge such as law and economics to study financing problem in transformation of agricultural scientific and technological achievements has important theoretical and practical significance.In order to solve the financing problem in transformation of agricultural science and technology achievement, this study first summarize some basic theory. We choose the farmer rights and interests and interests mechanism theory, asymmetric information theory, the financial growth cycle theory to demonstrates the necessity of financing in agricultural science and technology achievements transformation. Combined with multidisciplinary perspective, the article also explain the category and the characteristics of TASTA, the connotation of the financing in agricultural science and technology achievements transformation. All of this is try to provide theoretical support for perfecting legal system of agricultural science and technology achievements transformation financing in China.Secondly, the article illustrates the basic situation of TASTA and the financing in transformation of agricultural science and technology achievements. It reveals why agricultural science and technology achievements transformation has financing problems, include unreasonable resource allocation, the system of the financing of the intellectual property pledge is not perfect, and fiscal and taxation policy implementation does not reach the designated position, the lack of lack of credit guarantee and evaluation system, etc. This part pointed out the direction of solve the problem of financing difficulties in TASTAAgain, this paper expounds the policy and practice of financing in TASTA in United States, Japan and South Korea, analyses the factors that influence the financing policy choice and running performance. on this basis, the article summarize the experiences for our country study, those are choosing the right financing system and policy, increasing financial capital investment, playing policy auxiliary function, constructing the credit guarantee system of enterprises, and developing the multi-level capital market, etc.Finally, the article proposes some countermeasures for the legal issues of financing in transformation of agricultural science and technology achievement.: One is to improve the legal system of the financing in TASTA., including to improve the financing subject system, adjust the fiscal and taxation support system, and improve the system of intellectual property pledge financing, etc.; The second is to perfect the policy incentives and safeguards of financing in transformation of agricultural science and technology achievement, including improve enterprise’s financing ability, strengthen the governments support, improve the management of the fund, introducing risk investment, etc.This article hopes to provide a reference for government departments when they formulate laws and policies, to ensure that transformation of agricultural scientific and technological achievements can get enough money. |
