Study On The System Of Illegal Credit Card In China

As a new type of credit card payment, the credit card has more and more influence on people’s economic life, according to Chinese credit card industry development Bluebook China Banking Association issued "(2012)" it shows that by the end of 2012 there were 330000000 credit cards issued. And China’s credit card business development is accompanied by credit card dispute which has become more and more serious. Investigating its reason, it is largely due to the lack of integrity, the equilibrium and coordination of China’s current credit card illegal responsibility system, resulting in that the vast majority of credit card can not be effective in the prevention of illegal acts in advance or after reasonable imputation, boosting credit card dispute intensified. In view of this, the author thinks that it is necessary to conduct in-depth research on China’s credit card illegal responsibility system.The main content of this paper includes three parts:the first part is the credit card accountability system questions and define the basic concepts of the two part, clear be overdrawn credit card is the research object of this thesis; the second part is the analysis of card illegal responsibility system present situation and the existence of our country’s credit problems, focusing on the current credit card illegal legal liability is overweight, low threshold for conviction, civil legal liabilities, difficult to put in place, the lack of legal liability, financial supervision and so on; the third part is to improve our country’s credit card illegal responsibility system, first proposed the credit card reconstruction illegal responsibility system some principles from the macro, and then a clear path to improve our credit card illegal responsibility system from the point of view, finally puts forward the concrete measures to improve the country’s credit card illegal responsibility system.
