International Law Of Harnessing Foreign Investment To Promote Environmental Protection And Revelations To China

The development of investment liberalization has deepened its impact on environment protection and furthered the interface between international environment law and international investment law. Undoubtedly, foreign investment will have some impact on the local environment. Governments and the international community have taken a number of regulatory measures to protect the environment, and corresponding environmental provisions have also been set up in international investment agreements to regulate the activities of foreign investment. However, it should be noticed that the foreign investment’s impact on local environment doesn’t limited to the aspect of destruction, sometimes it also reflects the aspect of positive protection. At the moment, the regulations for foreign investment basically put their emphasis on the prevention of environment destruction, but ignore the predominant role and positive effect of foreign investment in environment protection. This dissertation through analyzing the interaction of foreign investment and environmont protection in the framework of international law, tries to includes foreign investors into the regulatory range of international environmental law, in order to fulfill the objective of promoting environmental protection by introducing foreign investment through legal measures. At last, this dissertation analyzes the current situation of environment protection and foreign investment in China and proposes corresponding improvement measures.
