Study Of Basic Problems Of China’s Energy Security Legislation

The appearance of energy not only changed the way of economic development, but also changed the way people live. The world economy has seen booming developing trend through The Industrial Revolution, and human beings cannot live without coal, oil, natural gas and other energy resources and other secondary energy such as electricity. Three oil crisis forced many countries to folly recognize the human activity and socio-economic development’s dependency on energy, which put energy security onto the agenda of legislation. The legislation of energy security in our country is still in its infancy, according to the present situation of energy security legislation in China, this paper briefly discussed the fundamental issues of energy security legislation such as the basic principles and the basic institution.This paper is divided into three parts.Part Ⅰ:briefly introduced the connotation and evolution of energy security, and defined energy security from the perspective of its relationship with economic development and environmental protection. Commenced on the necessity of energy security legislation in the light of the problems and challenges facing China’s energy security.Part Ⅱ:refining summarized the basic principles which energy security legislation should follow, including maintenance of the security energy supply, rational use of energy, environmental protection and rational structure of energy resource and consumption, and the content and implementation of all principles are briefly described.Part Ⅲ:First, evolution and current situation of China’s energy security legislation have been summarized and assessment, followed by introduction of energy security legislation of the United States, Japan, Germany and assessment of the relevant laws and systems involved. Finally, concludes some institution that we need to establish urgently, including energy unified planning and management system, rational development and utilization of energy system, energy conservation and energy reserve system, and analyzed the establishment and implementation mechanism for each system.China’s energy security situation is grim, legislation needs improvement. Defining the meaning of energy security helps to determine the goals of legislation; clearly making the basic principles of energy security legislation is conducive to grasp the legislative direction; building the basic system of energy security helps to ensure the implementation of legislation.
