A hundred years ago, to fight against narcotic drug abuse, countries established The International Opium Convention, the first international convention on drug management. Since then, the international community has been making great importance to and strengthens the crackdown of drug crimes. And the corresponding prevention and treatment policy of drug crime also changes with the evolution of criminal law theory, especially the process of abolishing or setting up confiscation in the penalty system. The purpose of applying the confiscation is definite, but considering its legitimacy problem, how to define it remains a theoretical controversy. This article parted with the help of the international legislation and domestic legislation, demonstrated the legitimacy of confiscation, and put forward the blue print of perfecting the confiscation system in China.
