May 1st 2011, Amendment Ⅷ to the Criminal Law of the People’s Republic of China was officially implemented. Among them, Article 2, One paragraph is added as Paragraph 2 of Article 38, which reads:’Where a criminal is sentenced to public surveillance, he/she may also be prohibited, during the term of public surveillance, from engaging in certain activities, entering certain regions or premises, or meeting with certain persons, depending on the circumstance of crimes committed.’ Prohibition order system is an important innovation of China’s penal system. It has very important significance. This article attempts to explore the theoretical and practical issues of the Prohibition order System. Find out the currently difficulties and doubtful points of the Prohibition order, which encountered in work. The article make relevant recommendations which response to these problems and countermeasures. This article is divided into four chapters.The first chapter describes the practical significance of Prohibition order system from the macro aspects. And describes the value of the Prohibition order system.The second chapter focuses on the concrete application of the Criminal Prohibition order. Specifically addressed the Prohibition order system with the applicable substantive conditions and procedural conditions.The third chapter, author compare the same or similar systems of the common law and the civil law, which draw useful experience for our Prohibition order.Chapter Ⅳ, Analysis the main problem with running defects, identify problems, analyze the causes of the Prohibition order in Legal Practice. On this basis, propose practical recommendations and ideas to improve our Prohibition order system.
