The Selection Between Individuals And Group: The Historical Exploration And Analysis About The Evolution Of Civil Law On Value Tropism

This article is according to the development of the civil law as history, according to the selection that people as individuals value tropism and groups value tropism in the civil legislation and practice as this narrative will demonstrate. On the basis this theory was analyzed under the philosophy of law between individual values and groups values concerning tropism and that relationship. We will examine the history of civil law, and research the law under the different historical conditions. Final, we will discuss transformations for the modern civil law value tropism. The value tropism of contemporary civil law should not be determined by group selections, but should return to one individual person, who highlights for the protection of the weak. This article will argue that the scope of civil law value tropism is set between the individual and the state, individuals and social groups, and individuals, rather than simply to express the standard of civil law according to social tropism.
