In this thesis, the concept, feature, legal basis, procedures of Criminal Judicial assistance were described, the historical process and development situation of Chinese criminal judicial assistance were analyzed in order to find out the main problems matters to extradition and highlight the necessity of perfecting the criminal judicial assistance systemAssistance in criminal justice is one of the major contents in international relations, in recent years it has become a hot spot of common concern to the international community. Assistance in criminal justice is a legal system based on the treaty and mutually beneficial principle among countries and regions, combating international crime and fulfilling the certain litigation matters. With the development and expanding content of Assistance in criminal justice, the basic principles was accepted by the international society, especially the valued experience from the European countries. A study on the issue of Assistance in Criminal Justice, to be specific, establishing a modern extradition system, is of great significance for combating international crimes, extraditing international criminals, claming against those who commit crimes in other countries for criminal liability and supervising proceeds of crime. Therefore, the problems of establish practical and feasible modern extradition system and overcome its own legal problems have not been solved yet. It still has a long way to go to improve the system of the Criminal Justice Assistance.The thesis focused on the present situation and problems of the criminal justice assistance. The purpose of the research is to seek out the measures to improve the system of the criminal justice assistance in China.
