The administrative hearing system is one of the important basic system of administrative procedure law. Administrative system in our country is still in the initial stage, there are still many problems to be solved, such as the way of production permission hearing the narrow scope of application, the hearing director’s responsibilities are not clear, the hearing on behalf of the not reasonable, the effect of hearing record deficiency and hearing publicity etc..This article bases on the view of social security hearing Chinese practice, starting from the analysis of legal problems in our country’s administrative hearing, discusses from the overall current administrative hearing of our country social security hearing problems and present situation, the experiences of other countries, combined with China’s legislative defects of law in the administrative hearing, puts forward the legislative suggestion the legal system of administrative hearing system of our country, aims to provide some suggestions and ideas for legislators and policymakers, as a meager strength to perfect our administrative hearing system and the social security hearing legal system.
