Consummation Of Administrative Legislative Hearing System Of China

With the implementation of the newly-revised Legislation Law of the People’s Republic of China, the legislative power of the administrative subject is expanded, which brings new challenges and opportunities to the rule of law. In order to maintain the constitutional rights of citizens and restrain the legislative power of the administrative subject, western society develops the administrative legislative hearing system vigorously. China also takes the initiative to promote the development of administrative legislative hearing system under the guidance of the concept put forward in the 17 th CPC National Congress, namely “to improve the democratic system, enrich the forms of democracy, and expand the orderly political participation of citizens”.However, there are still many problems in the administrative legislative hearing system in China,due to the weak procedure consciousness and sense of dignitary value, as well as the administrative tradition and economic guarantee, etc. In this paper, problems in the start-up stage,preparation stage, operation stage and end stage of the administrative legislative hearing procedures are analyzed respectively by combining the cases in Zhuhai, Chongqing, Sichuan,Heilongjiang, etc. with literature analysis method and comparative analysis method, Meanwhile,approaches of improving the administrative legislative hearing system in China are discussed by aiming at the problems and referring to the foreign experience and current legal designs in Guangzhou and Shanghai.
