Reconstruction Of City Residents’ Autonomy Legislation

City resident autonomy is not always being there, it is a product of the development of the country’s democracy and legal system. China’s urban grassroots management system go through the period of feudal autocracy " Wushi system" "Baojia System" and the Early New China"unit system" "Street Habitat system".Until the reform and opening-up, city resident autonomy was really established as the city residents grassroots management system. For the protection of the city resident autonomy’s realization, the national legislature and the executive authorities have formulated various forms of the laws, regulations and other legal documents. However, As far as the current situation of China’s city residents’ autonomy legislation, from the national to the community level’s legislation all have some problems. Especially with the continuous development of democracy and the rule of law, community building, the current city resident autonomy legislation is not the good solution to some new problems emerging in the construction of city resident autonomy. Such as:the Community party and community property organization was marginalized; a community self-service organization is difficult to grow and develop; the community autonomy substance security system is not perfect; community self-management, financial management system is not opaque. To solve the legislative current problems, we should under the premise of adhereing to ourselves legislative characteristics, combined with ourselves practical needs of city residents autonomy, and by the mean of strengthen understanding the relevant legislation of Chinese Hong Kong, Chinese Taiwan, Singapore, the United States, Japan and so on, to learn and absorb the overseas city residents autonomy legislation’s essences. We should strive to departure from all levels of city residents’ autonomy legislative system. From to explicit city residents autonomy system, improve residents’ self-monitoring, material security mechanism, to achieve the reconstruction of resident autonomy provisions of the Constitution;We should proper hand the relationship between neighborhood committees and Community party,to focus on reconstruction of urban Residents’ Committee Organization Law; to standardize the system of local-level legislation, to achieve the reconstruction of the local level legislation; to perfect single-line regulations, to achieve reconstruction of the legislation on community level.
