| In 2016,the General Office of the Guizhou Provincial Government issued a document stating that City G will be built into a demonstration area for the integration of smart healthcare and elderly care and a destination for healthy elderly care.The concept of smart elderly care services first appeared in the normative documents of Guizhou Province.On the one hand,according to the relevant content of the Fifth Plenary Session of the 19 th Central Committee of the Communist Party of China,responding to the aging crisis has become a national strategy;The local level has just started,and the pilot of the development and application of the smart elderly care service industry has begun.According to the relevant documents,the national action plan for the development of the smart elderly care industry will cover from2017 to 2020.At the same time,the application of smart elderly care has also been carried out to the third batch of pilots.Some units in G City of Guizhou Province have been selected for application pilots.This article contains five parts.The first part is the introduction.It mainly analyzes that in the context of global aging,the development of smart elderly care services has a great positive effect on the aging crisis,but the development of legislative protection is slow,and it is urgent to improve the legislation to escort the healthy development and promotion of smart elderly services.It also includes a literature review focusing on the status quo of domestic and foreign smart elderly care services related legislation,and describes the research methods of this topic,the process of research in the elderly care institutions in G city,and the basic information obtained.The second part analyzes the connotation research of the smart elderly care service academia combined with the central documents on the description of smart elderly care services,and combs the domestic and foreign smart elderly service laws and regulations including G City,and elaborates the legislative guarantee of smart elderly care.The necessity and particularity of The third part is based on the constitutional laws,national planning outlines,regulatory documents of the State Council,departmental regulations,and policy documents on smart elderly care services in Guizhou Province and G City.The lack of legal system and other legislative issues and causes of service legislation are clarified.The fourth part analyzes the legislation protection situation of developed countries that have developed earlier and more mature foreign smart elderly service legislation,and summarizes the characteristics and legislative experience of foreign smart elderly service legislation.In the fifth part,based on the sorted out issues of smart elderly care legislation in G City,combined with the actual situation and with reference to domestic and foreign legislative experience and relevant national policies and regulations,it puts forward a clear concept of smart elderly care service legislation in City G,and legislation to promote the development of smart elderly care service industry in City G,Improve the basic supervision system of smart elderly care services in City G,and legislative directions and countermeasures to protect the personal information security of the elderly in smart elderly care services.In the research process of the thesis,five different types of elderly care institutions in City G were selected,and through various methods such as field surveys and interviews,literature research,etc.,problems were discovered,and problems
