Study On Legislation Of Urban Administration In City Zone

As the new ? Law on Legislation ? formally endows the local legislative power of each district and expands the level of each local legislation,most city zone in China have issued the? xx Municipal Local Legislative Regulations ?and actively carried out the practice of urban administration legislation based on local legislative authority.This paper takes the existing legal texts of 45 city zone as the analysis sample and entry point,aiming at perfecting the scientific nature of district city administration legislation,using literature analysis,field investigation,comparative analysis and so on,deeply analyzes the present situation and effect of district city administration legal system and its operation,finds out the outstanding problems existing in our country's urban administration legislation,clarifies the key links and weak items of district city administration legislation activities,and puts forward some suggestions for improving district city administration legislation with the clear local legislative demand and strengthening legislative capacity.At the same time,we should carry out the leading spirit of the people's Congress on legislative work in depth,attach importance to the transformation of legislative ideas,attach importance to the characteristics of local legislation,scientifically standardize the legislative rights and obligations of the competent organs,realize theeffective improvement of the technical level and legislative quality of urban management legislation,and enhance the operability and scientific nature of urban management legislation.This paper mainly includes three parts: introduction,text and conclusion.The introduction briefly explains the background and significance of this topic,and summarizes the current domestic and foreign related theoretical and practical results,and briefly expounds the research ideas,structure and research methods used in this paper.The text is divided into four parts,the first part of the basic theory of urban management is summarized and analyzed.The concrete analysis defines the concept and characteristics of urban management legislation,the three basic categories of urban management legislation,and the three practical values of urban management legislation.In the second part,based on the comprehensive and systematic empirical analysis of the existing 45 district city administration legislation texts,the present situation of China's urban management legislation is analyzed and studied,and the comparative summary is made from the legislative concept,legislative content,legislative model,legislative characteristics and so on.The third part mainly analyzes the prominent problems existing in the urban management legislation,and analyzes and demonstrates the four problems,namely,the vague content of the urban managementlegislation,the lack of obvious features of the urban management legislation,the outdated model of the urban management legislation,the lack of scientific concept of urban management legislation and the concrete performance of the ten aspects.The fourth part mainly puts forward and demonstrates the basic countermeasures and suggestions to improve the legislation of urban management in China.From four aspects: innovating the concept of legislation,constructing pluralistic legislative model,standardizing the content of legislation and condensing the characteristics of legislation,this paper analyzes in detail how to improve the quality and level of legislation by using the advanced experience of urban management legislation at home and abroad for reference.The conclusion part,the research ideas and conclusions and limitations of the full text are briefly analyzed.
