The Legislative Conception Of Insurance Assessor System In Our State

Along with the economical development, the chaos of insurance assessment market in practice restricts the development of the insurance market. The reason is that the system of the insurance assessor is imperfect. Legislative blank and its own defection in practice have led to the slowing development of the system of the Insurance assessor.This paper aims at formulating perfect insurance assessor system, puts forward comprehensive, specific suggestions and carries on the proof to their feasibility. Based on the legislation and development status of the insurance assessor, theoretical analyses are carried out, then the paper puts forward suggestions in perfecting insurance assessor system.Firstly, this paper adopts the literature research method, to review the historical development of insurance assessor and summarizing its concepts, to compare its characteristics, types and related concepts, and to deeply explore its essence from the theory. Secondly, this paper adopts the history analysis method, to narrative development course and status of insurance assessor legislation in its legislation and practice, and to find and put forward the problems which exist in practice status and the legislative status. Thirdly, the comparative analysis method is used in the third chapter, to narrative insurance assessment system of foreign countries and compare with it of China, and find the defects of our country, and then propose relevant suggestions in improving China’s insurance assessment system, combined with what has described previously. Finally, the paper summarizes the problems found in this paper, puts forward feasible suggestions in the light of the shortcomings exists in the current legislation and the market, and carries on the proof to their feasibility and put forward specific implementation measures.The main results of this paper are:to analyze from the view of the market function, to make clear the market position of the insurance assessor; This paper puts forward the suggestions which give insurance assessment report legal proof, and demonstrates their feasibility from the aspects of their influence, facts and the specific measures implemented after the adoption of the suggestions. The theoretical analysis and the conclusion are carried out for the imputation principle and elements in the civil liability of the insurance assessment, and then there’s legal basis of the related responsibility in legislation Supervision system orders to establish insurance assessment association, and it is dominated by the state, association and social supervision as its supplement.
