Research Of Insurance Assessment Reports' Legal Issues

Insurance assessment report is the insurance assessment institutions in independent third person's point of view with the professional knowledge and experience, in accordance with the law, independent, objective and fair to make authoritative report. Theoretically insurance assessment report is highly probative, but in practice the insurance assessment report has been questioned, which influence the development of the insurance assessment industry. From three aspects, the author analyzes the reasons of insurance assessment report denied: professionalism, independence, the system. In our country insurance assessment institutions weaker leads to low level of their own professional.The deficiency of the qualification authentication system and staff continuing education training system cause the personnel quality hangs down. Insurance assessment institutions have high dependence to the insurance company, causing loss of independence of insurance assessment institutions. Supervision and restriction mechanism, legal liability system are not perfect, so there are many illegal operations under the influence of interests.Finally, this paper bases on the advanced experience and the actual situation on China, puts forward perfect opinions. Firstly, we should strict level qualification examination, improve the system of practice and continuing education, standardize assessment program, construct independent third party's evaluation system, perfect the market access and exit mechanism to strengthen the construction of professionalism and independence. Secondly, we should improve the system of industry legislation, autonomy statute and letter wrap around to build the supervision system. Finally we should clear the responsibility identification standard, the standard disclaimer, establish and perfect the system of recovery.
