The Study On The System About Prison Information Detection

As an important judicial power, in-prison investigation right authorized by law, prison information detection is playing an decisive role in maintaining the order of prison management, which could help decrease the re criminal rate in prison,improve the quality of the criminal management and so on. However, due to the relevant legal provisions on this problem are simple and rough, the theoretical research is relatively less, the practice operation of this system is not unified and standardized, even seriously restricts the practical utility of the system. From the perspective of this, combing with my personal research visit, this paper analysis the issue based on the outcome of researches of the predecessors.This article is about thirty thousand words, divided into an introduction, body and conclusion of three parts. In the text is divided into four chapters, as follows:The first part, to sort out and analysis the current theoretical and legal text concepts about the prison detection information. To distinguish the related concepts easily confused in the judicial theory and practice. By using historical analysis method to investigate the history, at the same time absorb the outstanding achievements of our predecessors, to propose my own view.The second part, investigate the current situation of the prison detection information, focus on analyzing the matter in theoretical study, legisative regulation and judicial practice.The third part, defining the justification and necessity of the prison detection information exists. It is the "necessary evil" or the democratic society under the rule of law, although there are still fraud factors but it is tolerable, does not violate the "judicial integrity". In the judicial practice, as a part of the country’s indictment, the prison detection information’ investigation can not not only be a mutual cooperation jointly to solve cases with other departments, but also maintain security of prisons, and safeguard social stability.The fourth part, the author start from China’s judicial quot status, to put forward own views on building principle, substantive laws and program specification of system.
