Study On Legal Issues Of Goods Clearance Underthe Trade Facilitation

Recent years the foreign trade of our country has developed rapidly. Especially in the twenty one century, Along with China entry into WTO and compete in the global integration with the deep development,making the voice of community’s growing to the trade facilitation.So, raising new demand of goods clearance issues.The issue of trade facilitation covers all aspects of international trade, but trade facilitation presented to the latest WTO Doha Round negotiations to develop "Trade Facilitation Agreement" can be seen in the clearance in the entire trade facilitation of the process plays an important role. The " Trade Facilitation Agreement " from a proposal to form the final collapse has once again reminded us that the existing international legal regime for trade facilitation, customs clearance under the legal problems still exist many problems. Analysis of the legal issues that exist in the clearance and find a solution,to further promote trade facilitation to improve the legal system plays an important role.This paper consists of three parts four parts. The second part describes the international law of goods clearance under the trade facilitation. Including three legal documents of WCO and "Trade Facilitation Agreement" of WTO. At the same time, Listing the measures of regional international organizations in goods clearance under the trade facilitation. The third part of the article describes the Clearance Status and clearance system of the United States, Japan and Singapore. Summarize their experience in customs clearance. Provide a reference for Chinese customs facilitation reform. The last part of the article is to improve trade facilitation under Chinese goods clearance system. First of all, in ETI2014 and Doing Business 2015 report shows, Customs clearance facilitation extent China is only at the middle level of the world. Customs clearance efficiency has much room for improvement. Of course, China has been a lot of facilitation reform measures in recent years. Such as paperless customs clearance, single window system and so on. China ’s customs clearance system is constantly improving, but there are many deficiencies can be improved.
