Research On The Legal Regulation Of Customs Clearance Under The New Development Of Trade Facilitation

"Agreement on Trade Facilitation" is not only a breakthrough of multilateral trade negotiations,but also a new development in the area of trade facilitation.In the past,the terms of trade facilitation scattered in various agreements of WTO,were short of operation,which could not meet the development needs of the current international trade.It is imperative to form a unified and coordinated specialized treaty.The purpose of WTO trade facilitation is to simplify and coordinate the international trade procedure,and therefore customs clearance system becomes the focus in the field of trade facilitation.Unlike soft law mechanism of the customs system of the World Customs Organization,"Agreement on Trade Facilitation" affected by the principle of "package of agreements" will bind strongly on the WTO dispute settlements.If the members break promise,they have the risks to take obligations under international law.The international community is trying to promote the entry into force of the Agreement.As the number of members of the treaty accepted is gradually close to the entry into force,the treaty is due to come into effect.China has approved the "Agreement on Trade Facilitation" and submitted to the WTO for acceptance.This has also accelerated the urgency of the reform of customs clearance.This dissertation tries to find out the challenges of China's customs system by studying the agreement,and makes recommendations on the improvement of the customs clearance system so as to meet the promise of the agreement.
