The Application And Research Of Dispute Review Board In Claims Of International Projects

This paper mainly studies an International Project which occouring lots of Variations and Claims and get the claim aims through unremitting efforts. The first phase is the amicable negotiation phase, then “Engineer Decision” phase, and then Dispute Review Board Phase according to the Contract Clause. After around one year,finally we get the expected claim result, and certainly get some economic benefits.Firstly the paper introduces the definition, the operational procedures and the advantages of the Dispute Review Board system applied for international project claims, discusses the importance of DRB system in resolving the construction project disputes, and further studies the solutions and working plan of international project contract disputes. Secondly, based on the author’s experience of succeeding in getting claims through Dispute Review Board system in an international project, this paper analyzes this case of the international project using Dispute Review Board to claim in the view of the Contractor, and briefly states the detailed information of this project,the the process of the resolution of the disputes and the operational procedure, and the claim result. Finally the paper concludes some experience and lessons in dealing with claims and disputes for international projects.The author brings the claim theory to a new level after systematic learning and study. Through the careful study to know the application situation and the new theories of the Dispute Review Board at home and abroad, states the different characteristics, and then concludes the aspects of Chinese construction companies which need to be improved and the problems of China Dispute Review Board in the government and enterprises, hoping to help management dealing with international construction claims and the Chinese construction enterprises resolve the claim problems when “going out”.
