The Discussion On The Legal Protection Of Privacy Right

From public figures to ordinary people, the rights to privacy has caused enough attention, this is mainly due to the rights of privacy is the symbol of the modern citizen personality freedom and dignity. Legal protection of privacy in our country, however, there are many problems, for example:the legal protection of privacy in our country belongs to the indirect protection; Our country law provisions of the right of privacy is too simple, scattered, lack of system and so on. In this paper, the author, aiming at the problems in the process of privacy protection, put forward some own views, in order to improve the legal protection system of privacy. This article is divided into three chapters altogether.The first chapter is our country legal protection of privacy problem and its reason analysis. The author first analyze and define the privacy of some basic theoretical issues. Then the author analyses the legal problems in the process of privacy protection in our country, and further analysis the cause of these problems.The second chapter is our country law specific provisions for protection of privacy and its evaluation. Our country constitution content itself has abstractness, the lack of specific rules of privacy protection system, the lack of corresponding regulation measures of privacy infringement. Our country civil law and relevant judicial interpretations, not from perceiving privacy provisions for a kind of personality right, such as reputation and independent personality right. For privacy, although there is a simple procedure law in our country, but there is a big defect.The third chapter is our country legal protection of privacy embodies the build. The authors should establish a legal protection system, with emphasis on the civil law, the right of privacy, including:one, on the premise of the constitution declared; 2, with an emphasis on the civil law protection, from the perspective of the civil law clearly define the right of privacy as an independent right of personality; Three, with criminal law, procedure law and other legal protection for the supplement, the first thing to strengthen the legal protection of privacy, criminal law second to perfect the procedure of privacy protection rules, especially to the right of privacy infringement cases in filing, investigation, trial, the respect such as forensic aspects in detail.
