Study On Enforcement Concerning Exit And Entry Frontier Inspection In China

Exit and Entry Frontier Inspection refers to the administrative activity of examination and supervision on the people, vehicles, and their luggage crossing the border line, carried out by the Frontier Inspection organs. The Frontier Inspection organ is an important division of a government, which bears the governmental Frontier Inspection tasks, carries out governmental administrative power. With the increasingly frequent international exchange and the deepening intensity of "administrating in accordance with law" of China, the need of frontier law enforcement work is growing higher. How to level up our frontier law enforcement work to meet the need, and to better serve the international exchange, the development of economy and society, is an urgent and brand new question to the Frontier Inspection organs.This paper regularizes the basic concepts of Frontier Inspection and existing law enforcement system, summarizes the major problems of the Exit and Entry Frontier Inspection, parallels Chinese Frontier Inspection law enforcement systems with other countries’, makes comparative investigation. By the regulation, summarization, and comparison, we propose countermeasures in solving our country’s Frontier Inspection problems.There are still some problems to be solved in the process of Frontier Inspection, from legislation to law enforcement even though the new "Exit and Entry Administration Law" was adopted. These problems have become increasingly prominent, and seriously affect the development of Frontier Inspection law enforcement. These problems are mainly as follows: some content of "Regulations on Exit and Entry Frontier Inspection" is only for general requirement and lack of operability; the law enforcement organ of Frontier Inspection is unitary, and its authority is not clearly defined; the provisions relating to administrative punishment is too flexible; the process pf the administrative punishment is not clear and hard to execute; human rights are not adequately protected, and the quality of Frontier Inspection crew needs to be promoted etc.This paper regularizes the basic concepts of Frontier Inspection and existing law enforcement system, summarizes the major problems of the Exit and Entry Frontier Inspection, parallels Chinese Frontier Inspection law enforcement systems with other countries’, makes comparative investigation.
