Analysis On The Legal Issues Of Network Virtual Property

The rapid development of internet technology promotes the growth of a new thing, network virtual property. The development process of new things are always twists and turns, The number of disputes related to network virtual property is increasing year by year. There’s no clear orientation on network virtual property in our national laws because of relative lag of the law, it leads to that many owners of virtual property can not get effective protection. We should speed up the theoretical research of network virtual property and perfect the legal protection system according to the achievement in order to protect the legal interests of customers and fill up the blank of law.The author does some research work about the network virtual property on the concept, features and present situation, analyzes on the legal attributes and related legal relation, explores the main problems of the judicial practice of network virtual property, and puts forward some practical suggestions on how to perfect the legal protection system. The paper is divided into four chapters.Chapter one mainly introduces the concept, characters and protection situation of network virtual property. The problem that network has the features of virtual and reality, value, technical limit, legality and time limit is pointed out. Compared with the legal experience in other countries and areas, analyzes China’s legislative status and existed problems.Chapter two analyzes legal attributes of the network virtual property. The author comments on several views of the legal attribute of network virtual property such as the theory of denial, intangible property, intellectual property rights, personal right and real right, puts forward the point of this thesis that network virtual property is a special kind of obligatory right, and it should be protected.A detailed analysis of related legal relation, rights and duties of network virtual property is provided in Chapter three. The author put forward some suggestions on how to perfect the legal protection system in Chapter four. It suggests that we might make legislative explanation and bring the network virtual property into legal protection system, and then publish a special law to protect it in the matured conditions.
