On Network Virtual Property

In twenty-first Century, computer information technology, the height of the boom, the Internet has penetrated every corner in daily life in the invisible. The network virtual property emerge as the times require, it is a kind of binary data coding information storage through the Internet server. Which are derived from virtual property legal disputes is increasing year by year, the judicial practice of pressure increases, so we must explore the establishment of network virtual property legal protection system to complete. This article first separately from "virtual", "property" and "virtual property" concept, analyzes. Analysis based on generalization of the characteristics of virtual property, virtual property is the right of the theory expounded. The comprehensive comparison of the current academic circles on the virtual property of several theory point of view, the author finally concludes that the network virtual property is a new property right. Finally, in the base of defining property ownership and the law, analyzes the legal system of the virtual property, a comparative analysis of legislation of each country, respectively from the four aspects of real right law, tort law, contract law and law of succession analysis to establish the legal protection system of virtual property.
