The Research On The Legal Regime Of Space Debris Mitigation

Since the dawn of the Space Age, Earth Orbit has become a highly utilizedenvironment. The heavy traffic of man-made satellites has led to a large quantity ofdebris in orbit that distracts from the value that Earth Orbit provides mankind.Lamentedly, there is no strong international treaty which serves this purpose. Severaltechnical solutions exist and are capable of mitigating the space debris problem, but inorder to preserve the orbital environment, these technical solutions need to work inconjunction with a legal regime that regulates the creation and remediation of spacedebris. In this issue, the writer states the meaning, characteristics and basis of thelegal regime of space debris mitigation. I, then analysis the lacking of China’s outerspace legislation with research on the five outer space treaties and America andRussia’s legal regime of space debris mitigation. Meanwhile, the writer put forwardown opinion on legislative perfection of the legal regime of space debris mitigationand safeguard the outer space environment. In addition to forward and conclusions,this paper includes four chapters.The first chapter overviews the legal regime of space debris mitigation. Thewriter clarifies the development of the legal regime of space debris mitigation,category and hazard of space debris; summarize the meaning and characteristics of thelegal regime of space debris mitigation. Then the writer further analysis the basis ofthe legal regime of space debris mitigation. The second chapter is research on the international law of space debris mitigation.The writer analysis the outer space treaties and another two documents, study thecurrent legal regime of space debris mitigation under international law system.In the third chapter, the writer choose America and Russia as research objects toanalysis the background, legislative process and main content of their legal regime ofspace debris mitigation. Then the writer further analysis the merits of their spacedebris mitigation legislation.In the fourth chapter, the writer starts from the legislative perfection of China’space debris mitigation, analysis its problem and put forward own suggestions.And finally, the conclusion of this issue is written in the last paragraph.
