It appears from the present situation, less by the way of litigation for resolving medical disputes arbitration at present, only individual place has a medical dispute arbitration mechanism of specialized, mediation reconciliation are the main forms of the settlement of medical disputes. The way of solving the medical dispute in our country is still not enough to enrich and be perfect to solve various channels for each array, to integrate resources, resulting in medical disputes can not be timely treated. At present we have already had the implementation of the third party mediation mechanism, appeared in the Ningbo mode, Shanxi mode, Tianjin mode, but the present third party mediation mechanism still has some problems, such as the third party without independent mediation system, the lack of real system, start the third party mediation mechanism and mediation standard without a scale, the lack of legislative guarantee and so on, based on this, to make better and more effectively play its due role in the third party mediation mechanism. We must improve from the name of legislation, organization, all aspects of jurisdiction, personnel and financial security, etc.
