The Status And Enlightenment Of The Cognition Of The Third Party Mediation Mechanism In Medical Disputes Between Doctor-Patient Relationship In Jilin Province

OBJECTIVE:Due to the late development of third-party mediation in medical disputes in Jilin province,it is necessary to refer to various models that have been formed nationwide under the provisions of relevant laws,develop a third-party mediation mechanism for medical disputes with geographical characteristics,and effectively resolve medical disputes.Third party mediation in medical disputes can effectively safeguard the legal rights and interests of doctors and patients and ensure the stability of medical facilities.In addition,it is also hoped that this study can provide a theoretical basis for relevant organizations to formulate doctor-patient dispute resolution methods and methods,and put forward targeted suggestions to improve the shortcomings in the prevention and handling of medical disputes and alleviate the doctor-patient conflicts.We will improve the existing medical mediation mechanism,innovate the medical mediation model,and broaden the channels for medical mediation,so as to provide suggestions and countermeasures for the development of medical dispute resolution mechanisms.METHODS:The data of medical workers and the social members in Jilin Province are collected using a convenient sampling method.Through the questionnaire survey to understand the current situation on part medical institutions of third-party mediation on medical dispute in Jilin province,and found that the third-party mediation is existing some problems.Through the cognition and views on medical workers and social members about the third-party mediation on medical dispute and the choice on the way for solution towards the medical dispute.Through the interviews of related personnel in Changchun medical dispute mediation committee and Siping medical dispute mediation committee to analyze the problems of situation on medical institutions of third-party mediation on medical dispute in Jilin province.Using descriptive statistical analysis method to describe the basic variables.Using the rank sum test method to find out the current situation of doctor-patient relationship status on medical workers and social members and mandatory acceptance of the predisposition of the medical adjustment committee,to analyze the advantages and disadvantages by single factor and other methods to resolve medical disputes.RESULTS:It can be seen from tables 3.4 and 3.17 that the condition of medical workers and social members' doctor-patient relationship is relatively good and the trusting relationship of doctor-patient is higher.Through a single factor analysis of the current stage on the doctor-patient relationship,and the examination and analysis of the difference at the doctor-patient relationship between medical workers and social members(P<0.01),statistically significant.The investigators all think that the current state of doctor-patient relationship is better.Medical workers and social members' understanding of the The People's Mediation of Medical Disputes Commission is only 19.8 % and 6.8 % as well knowna very low proportion.It can be seen that at this stage,the level of social members' perception on the The People's Mediation of Medical Disputes Commission is lower,it should be raised the realization in different ways.In the compulsory pre-mediation procedure,more than 56.4 % of medical workers fully accepted,and the social's acceptance level also reached 20.1 %.High-ranking hospitals also accepted the mandatory pre-mediation of the Medical Commission.Both medical workers and social members agree with the important role in the medical regulatory committee in resolving medical disputes.In terms of composition,they tend to be professional and choose the fewest administrative personnel to involve.Both doctors and patients pay more attention to the neutrality place of mediation in the process of dispute mediation.They want less people to involve in it,because they are worried about choosing a way to resolve medical disputes.Comparative analysis of different solutions to medical disputes,and statistically significant that using check analysis to figure out the differences of in private and others solutions between medical workers and social members(P<0.01).CONCLUSION:1.It's a good condition of doctor-patient relationship in Jilin Province,and the proportion of medical workers involved in disputes is not very high.They had a certain understanding of dispute handling.2.The success rate of People's mediation in medical disputes is high,but the degree of understanding of the mediation method itself is low.3.It still has some problems such as unreasonable personnel composition and imperfect legal construction of People's mediation in medical disputes.4.It need to lay the emphasis on specialization in the composition of mediators,and the participation of medical and legal experts.This is an important measure to solve the existing problems.5.To innovate mediation mechanisms,mediation methods,etc.gradually to satisfy the needs of modernization,and facilitate the parties.6.To establish an effective evaluation system to supervise the mediation process and results of the medical adjustment committee,and it can ensure the efficiency of mediation.
