Since the20th century, gun violence has troubled the U.S federal government, but with few federal legislations. What has caused this situation? In this paper, the development of the Brady Act as a case study, will provide a reasonable analysis for this problem. James Brady, seriously wounded in the Reagan assassination attempt, actively engaged in the campaign of gun control. Since the Brady Act came up in1987, undergo the continuous controversy between gun control advocates and gun rights proponents, the Bill was passed until November1993. During the implementation of the law, because of the Brady Act’s interim provision commanding the "chief law enforcement officer"(CLEO) of each local jurisdiction to conduct background checks, the Brady Act was ruled unconstitutional by Supreme Court of the U.S, on June27,1997. However, through the efforts of gun control advocates, states continued to execute the law. For the gun control problems, the federal government has to confront the harsh realities of gun violence, political culture of free expression in civic rights, and the jurisdiction of the federal government itself. The case study of the Brady Act can be regarded as a miniature of the gun control in federal government, which shows the role and the difficult situation of the federal government between maintaining public security and safeguarding citizens’ right to bear arms.
