On Financial Supervision Of The Government

Government financial power is the base that national authorities manage public affairs,and the legitimacy and rationality of government spending will affect the stability of acountry’s economic development and political situation to a certain extent. The paper mainlydiscusses the oversight on government expenditure power. It clearly outlines that financialspending power should be correctly exercised, strictly controlled and monitored inconstitutions all over the world. Chinese Constitution, Budget Law, Audit Law, SupervisionLaw and other related laws also clearly stipulate the oversight of government financialspending, which is not only a necessary requirement of building legal government, but also areliable protection of the civil property rights.In recent years, the amount of government spending increases year by year, and the fieldof fiscal expenditure is increasingly expanding, causing severe waste. Therefore, it isnecessary to supervise the standardization and rationality of government expenditure.Although the supervisors are widely in our country, mainly including national supervisionmode and public supervision mode, owing to various restrictions, the legislative level in ourcountry is currently still not advanced enough, and the two supervisory systems andprocedures exist some defects in practice, they can’t effectively control the unreasonablebehaviors of government spending yet.This paper is divided into four parts. The first analyzes supervisory power of thegovernment finance and related aspects. The supervisory power of the government financeoriginates from England. The purpose that set this right originally was to limit the king’spower, and to safeguard the interests of the bourgeoisie. The establishment of parliamentarysystem in British marked people have right to supervise the actions of administrative organs.Financial expenditure power means in accordance with law, the government takes thefinancial funds obtained by revenues into a planned redistribution by the use of politicalpower, aims at providing products and services for the public and meeting their interestdemand, so that the financial funds are configured appropriately. The oversight ongovernment spending epitomizes the principle of people’s sovereignty, the principle of checksand balances as well as the principle of democratic property. In our country, it has a closerelationship between the exercising of government spending and the construction oflaw-based government administration. The second part is a comparative analysis of the oversight system on governmentspending among UK, USA, Germany and Japan, respectively studying the legal basis andsupervision structure of the four countries, and it is an important enlightenment to improve thesupervision system of government fiscal expenditure in our country.The third part describes the current situation of government expenditure right andproblems of government expenditure monitoring system in our country. Since the foundationof the state, we have formed a relatively complete supervision system of governmentspending by continuous exploration and development for half a century. But there are stillsome flaws in government expenditure supervision system, for example, the relevant laws andregulations are not perfect, the set of supervision system is not scientific enough, the publicsupervision is not strong, etc. By analyzing these defects and causes, this part paves the wayfor the following measures proposed.The fourth part is the focus of the article. In allusion to the problems mentioned above,the writer considers Chinese judicial conditions, on the foundation of drawing the experienceof other advanced countries, proposes many specific solutions and measures, such asimproving laws and regulations, establishing a special budget supervision authority,introducing taxpayer litigation system, in order to continuously improve the supervision levelof financial expenditure, and to contribute to establish a practical system of governmentfinancial supervision which is suitable for the Chinese future development needs.
