In other areas of social science,"the crazy for Culture study" seems to have beenstudied in the past years, but in the field of criminalistic, it is a new study from recentyears. Throughout the past times, the culture was regarded as some kind of "softpower"and always impacted on the process of restricting the development ofcriminalistic. The progress of criminalistics essentially is a kind of description ofobjective facts, this description of the physical evidence is not equivalent to thedescription of the objective facts. Once technology was selected, it will be subjective.From the current judicial practice in China, clearly too many local-cultural factorswas considered in the process of use of technology, the analysis and evaluation of theevidence by the court, and the integration of criminalistics and local culture can easilyaffect results of judicial cases. Therefore, this paper attempts to combine nationalculture to the development of forensic science under a country-specific analysis of thehistorical background,put forward the concept of culture of criminalistics and deepenits meaning.Meanwhile, China and the United States belong to different cultural systems,comparing the two culture of criminalistic in these two very different culturalbackgrounds can enrich the connotation. Meanwhile,the culture of criminalistics inthe United States is featured and advanced. The differences between thedevelopments is essentially came from the differences between the culture ofcriminalistics.This kind of thinking could support searching a way to reform ourcriminalistics and forensic science system. Therefore this paper compare the cultureof criminalistics in the two countries so as to find development proposals in the fieldof Chinese criminalistics.This article is divided into four parts, the main content:The first part is overview of culture of criminalistics. First, introduce theCHI-US cases, make a brief comparison of these two cases, and think about the needof putting forward the concept of the culture of criminalistics; Secondly,put forward the concept of cultural and criminalistics, analyze the relationship betweencriminalistics and culture, define the concept of the culture of criminalistics; Finally,analyze the internal structure of it and propose framework of this research.The second part is the comparative of the history of the culture of CHI-UScriminalistics. First, briefly discussed human factors and technology factors inChinese culture of criminalistics, by describing the context of the history of Chinesetraditional Criminalistics culture. Then briefly discussed the history of the humanfactors and technology factors in the criminalistics culture in the United State.The third part is the differences between the culture of CHI-US criminalistics.The comparison are given respectively from human factors and technological factorsin CHI-US criminalistics.The basic elements of human factors include social,legalculture, aspects of thinking and so on. Technological factors mainly include scientificspirit, policy dissemination.Part IV is some suggestions, Which is made before to strengthen thedevelopment of Chinese criminalistics. The main recommendations from socialadvocacy,institution, education and the solution about controversy in forensic scienceis given. Valuable suggestions for the reform and development of China’s forensicscience are putting forward.
